PRIVACY POLICY

DEFINITION OF TERMS

1.1. The terms in the privacy policy have the following meanings:

1.1.1. “Management of the online-auction site” (hereinafter – management of site) – are employees who are authorized to manage the site, act on behalf of mybid, organize or process personal information, and also determine the aim of personal information processing, the content of personal information to be processed, and operations to be performed through personal information.

1.1.2. “Personal information” – is any information directly or indirectly belonged to a certain natural person (personal information subject).

1.1.3. “The processing of personal information” – is a set of any operation or operations related to the collection, recording, systematization, accumulation, storage, clarification (update, modification), extraction, usage, transfer (distribution, presentation, promotion), de-personalization, blockage, delete, destruction of personal information performed with or without automated means with personal information.

1.1.4. “Privacy of personal information” – means to comply with the request to prevent the distribution of personal information that is submitted to the management of site, without the consent of the owner of this information and other legal grounds.

1.1.5. “User of online-auction site (hereinafter – user)” –is a person who accesses and uses the online auction site through the Internet.

1.1.6. “Cookies” – is a small fragment of information sent by the web server and stored on the user’s computer, every time a web browser or web client tries to open a page on the corresponding site, it sends that fragment to the web server in an HTML request.

1.1.7. “IP-address” is a unique network address of computer network node organized by IP protocol.

GENERAL PROVISIONS

2.1. The user agrees to this privacy policy and the conditions of processing of the user’s personal information by using the online-auction site.

2.2. The user who does not agree with the conditions of the privacy policy must stop using the online-auction site.

2.3. This privacy policy is applied only mybid online-auction site. Online-auction does not control and is not responsible for links to Third party sites on its website.

2.4. The management of site does not check the accurrency of personal information provided by user of online-auction site.

THE SUBJECT OF PRIVACY POLICY

3.1. This privacy policy determines the obligations of the management of site to ensure the confidentiality and protection of the personal information provided by the user at the request of the management of site or when placing an order for the purpose of purchasing goods on the online-auction website.

3.2. Personal information authorized for processing within this privacy policy is issued by the user when filling out the registration form on the online-auction website and consists of the following:

Online-auction protects data which is transmitted automatically in the process of viewing advertisement blocks and during links to pages with a statistical script of the system: · IP address; · information from cookies; · information on browser (or other program displaying the advertisement); · access date; · address of page where the advertisement block is located; · referer (address of previous page);

3.3.1. Deactivation of cookies may make impossible to access to the sections of the online-auction site that require personal identification.

3.3.2. Online-auction collects statistical information on IP address of visitors. This information is used in order to eliminate technical problems, to control the legality of financial payments.

3.4. In addition to the above, any personal information (purchase history, browsers used, operating systems, etc.) is securely protected and kept confidential (except as defined in clauses No. 5.2 and 5.3 of this privacy policy).

AIM OF COLLECTION OF USER’S PERSONAL INFORMATION

4.1. The management of online-auction site uses personal information of the user for following purposes:

4.1.1. For identification of the user who registered in online-auction site, receiving an order or concluding purchase agreement for goods;

4.1.2. For the user’s access to the resources of the online-auction site;

4.1.3. For creating the feedback with the user, as well as providing information, requests, services related to the online-auction site (including the processing of the user requests and orders)

4.1.4. For determination of the user’s location in order to ensure security and to prevent fraud;

4.1.6. For creating an account for shopping, if the user allows to create an account number;

4.1.7. For providing information the user of online-auction site on status of orders;

4.1.8. For receipt and processing of payments, approval of taxes or tax benefits, objection to payment, determination of the user's right to credit;

4.1.9. For providing efficient customer and technical support to the user due to difficulties related to usage of the online-auction site;

4.1.10. For information on product updates, special offers, prices, sending updates and other information sent by online-auction or its partners with the user’s consent;

4.1.11. For performing advertising activities in accordance with the consent of the user;

4.1.12. For getting user’s access to the sites and services of online-auction partners and information about their products, services and innovations.

THE PROCESSING METHODS AND DURATION OF PERSONAL INFORMATION

5.1. The processing of the user’s personal information is legally performed indefinitely;

5.2. The user agrees that the management of site has a right to transfer personal information to the third parties (courier service, postal network, communication operators) in order to fulfill orders of the user and to ensure the delivery of the goods.

5.3. The personal information of the user may be transferred to the competent state authorities in accordance with legislation of the Republic of Azerbaijan.

5.4. When the user’s personal information is lost or disclosed, the site management informs the user about this issue.

5.5. During the processing of the user’s personal information, the management of site takes certain necessary organizational and technical protection measures in order to prevent illegal disclosure, accidental destruction, modification, blocking, duplication, distribution and other illegal actions of Third parties.

5.6. The management of site together with the user takes necessary measures in order to prevent damage and other negative effects related to the loss or disclosure of the user’s personal information.

THE OBLIGATIONS OF THE PARTIES

6.1. The obligations of the user:

6.1.1. To provide personal information required to use the online-auction site;

6.1.2. To update it, make additions in the case of information changes.

6.2. The obligations of management of site

6.2.1. To use the obtained information only for the purposes stipulated in clause No. 4 of the privacy policy;

6.2.2. To protect the confidentiality of private information, not to disclose it without the written consent of the user, not to sell, change, publish, or distribute the personal information of the user in other ways (except for clauses No. 5.2 and 5.3 of the privacy policy);

6.2.3. To take possible measures in accordance with the current rules in order to ensure the confidentiality of the user’s personal information.

6.2.4. To block personal information when the personal information of the user is checked by the competent authorities due to incorrect personal information or illegal actions, or at the request of the user or his representative.

THE RESPONSIBILITY OF THE PARTIES

7.1. The management of the site that does not fulfill its duties takes responsibility for the damage caused to the user in accordance with the legislation of the Republic of Azerbaijan (Except for clauses No. 5.2 and 5.3 and 7.2 of this privacy policy) due to the illegal use of the user’s personal information.

7.2. The management is not responsible for the loss or disclosure of confidential personal information in the following cases:

7.2.1. If the confidential personal information became publicly known prior to its loss or disclosure;

7.2.2. If the confidential personal information was obtained by third parties before it was given to the management of site;

7.2.3. If confidential personal information is disclosed by consent of the user.

SETTLEMENT OF DISPUTES

8.1. It is necessary to submit a written proposal for the settlement of the dispute through mutual understanding before applying to the court with a complaint concerned about disputes between the user of the online-auction site and the management of site.

8.2. The recipient of the complaint has to inform the complainant in writing about the measures taken within 30 calendar days from the receipt of the complaint.

8.3. Unless otherwise agreed, the dispute can be resolved through court in accordance with the legislation of the Republic of Azerbaijan.

8.4. This privacy policy and the regulation of relations between the user and the management of site are governed by the legislation of the Republic of Azerbaijan.

ADDITIONAL CONDITIONS

9.1. The management of site is entitled to make changes to this privacy policy without the consent of the user.

9.2. The new privacy policy is effective from the moment it is posted on the online-auction website. (unless otherwise defined in the new edition)
